GMT’s liability is excluded, unless

a) under the Product Liability Act,

b) due to willful misconduct or gross negligence,

d) due to the assumption of a warranty of quality,

e) due to fraudulent concealment of a defect, or

f) due to a breach of material contractual obligations (cardinal obligations)

liability is mandatory.

However, damages for breach of material contractual obligations (cardinal obligations) are limited to the foreseeable damages typical for this type of contract, unless there is intent or gross negligence.
